Court ruling favors Prime Inc over OOIDA

The United States Court of Appeals for the Eighth Circuit upheld Aug 21, 2003, all of the Federal District Court's rulings in the case of Owner-Operator Independent Drivers Association, et al versus Prime Inc.

This ruling stems from a lawsuit filed against Prime in 1997 alleging federal leasing violations and asserting class-action status. The US Court of Appeals held that class-action status was indeed not proper and that the lower District Court was accurate in its decisions dismissing the lawsuit.

Prime has instructed its counsel to file an application for attorney's fees as provided for under the US Code.

OOIDA has the option of requesting the Court of Appeals to reconsider their opinion or appealing the decision to the US Supreme Court.
