• Employee or contractor? A test to define your drivers

    The federal government has specific definitions of what constitutes an employee and what is a contractor. Trucking's business model involves significant use of contractors, but is that the right classification for these drivers? A carrier that incorrectly labels a driver as a contractor may be subject to legal action, penalties and remuneration of back pay. The Dept. of Labor has a 6-question test, entitled the "Economic Realities Test" to help businesses determine the correct classification for employees.
